Court Order for Child Care Leave
সরকারি প্রশাসকও সরকারি আইন সম্পর্কে সম্যকভাবে ওয়াকিবহাল নন। শিক্ষিকা কাকলি দাসের আবেদন খারিজ করে সেই প্রশাসক বলেছিলেন, যেহেতু 75 দিন ‘Child Care Leave (C.C.L)’ তাঁকে দেওয়া হয়ে গিয়েছে, তাই আর তা দেওয়া যাবে না। অথচ, সরকারি নির্দেশিকা অনুযায়ী, যে কোনও শিক্ষিকা তাঁর কর্মজীবনে মোট 730 দিন সন্তান কল্যাণে ছুটি পেতে পারেন। এই প্রেক্ষাপটে বিচারপতি শেখর ববি শরাফ ওই প্রশাসককে তাঁর নির্দেশে বলেছেন, চার সপ্তাহের মধ্যে ওই ছুটি অনুমোদন করতে হবে। রিষড়া এলাকার লালবাগান বালিকা বিদ্যালয়ে ভূগোলের শিক্ষিকা হিসেবে কাকলি 2001 সালে যোগ দেন। এই ছুটি 2015 সাল থেকে তিনি কয়েকবার নিয়েছেন। এবার 6 থেকে 20 September তিনি এই ছুটি চেয়েছিলেন। তা যাতে মঞ্জুর হয়, সেজন্য তিনি 16 ও18 July বিদ্যালয়ের প্রশাসককে চিঠিও দিয়েছিলেন। শেষ পর্যন্ত ওই প্রশাসক লিখিতভাবে কেবল জানান, ইতিমধ্যেই 75 দিনের বেশি তা দেওয়া হয়েছে।
সুতরাং, তা অনুমোদন করা গেল না। এই সিদ্ধান্ত ওই শিক্ষিকা High Court-এ চ্যালেঞ্জ করেন। কিন্তু, নোটিস দেওয়া সত্ত্বেও বিদ্যালয়ের তরফে Court -এ কেউ হাজির হননি। এই অবস্থায় মামলাকারীর আইনজীবী অঞ্জন ভট্টাচার্যের সওয়াল সূত্রে হওয়া একতরফা শুনানিতে বিচারপতি রাজ্য সরকারের 2015 সালের 17 জুলাই প্রকাশিত 5560/F (P) নির্দেশিকা পর্যালোচনা করেন। বিচারপতি সেই সূত্রে তাঁর রায়ে বলেছেন, ওই নির্দেশিকার কোথাও বলা নেই যে, 75 দিন Child Care Leave (C.C.L) দেওয়া হয়ে গিয়ে থাকলে, আর তা দেওয়া যাবে না। বস্তুত, সেখানে বলা আছে, কোনও শিক্ষিকা তাঁর কর্মজীবনে মোট 730 দিন বা দু’ বছর এই ছুটি পেতে পারেন। দেখা যাচ্ছে, ওই শিক্ষিকা 2018 সালে এই খাতে আগে কোনও ছুটি নেননি। তাই ওই প্রশাসকের সিদ্ধান্ত ভিত্তিহীন এবং তার আইনগত কোনও যৌক্তিকতা নেই। অতএব, এই Order হাতে পাওয়ার চার সপ্তাহের মধ্যে তাঁকে ওই শিক্ষিকার আবেদন মঞ্জুর করতে হবে ।

Maintenance of Roster for grant Child Care Leave

It has been observed that at present in may schools Child Care Leaves are granted without having due regard for academic and administrative interest of the institution and also often without having due and proper regard to the sequence of the applications for Child Care Leaves (C.C.L) received from different teaching and non-teaching staff.
It is, therefore, felt necessary that every school must maintain a Roaster for grant of Child Care Leaves and sanction those Leaves in accordance with extant Rules and in due observance of the sequence in the Roaster to ensure that the candidate praying for Leave earlier, if otherwise eligible, must have his/her Leave sanctioned by the Leave sanctioning authority earlier than those who apply for Child Care Leaves (CCL) later.
Henceforth the respective Leave sanctioning authorities must sanction Child Care Leaves accordingly.
The District Inspector of Schools should inform all concerned accordingly and maintain properly a suitable monitoring system to oversee adherence to the above-noted Roaster system.
