MEMORANDUM
Subject: Pension/Family pension in respect of the employees who retired or died in harness prior to 01.04.1981 under the West Bengal Recognized Non- Government Aided Educational Institutions.
The school Education Department has received a number of representations from different corners seeking clarification on the entitlement of pension/family pension in respect of the employees under the West Bengal Recognized Non-Government Aided Educational Institutions (hereinafter referred to as employees) who retired or died in harness prior to 01.04.1981 under the West Bengal Recognized Non-Government Aided Educational Institutions. This Department has also received several orders passed by the Hon’ble High Court at Calcutta directing the respondent authorities to extend pension/family pension under the West Bengal Recognized Non-Government Educational institution Employees (Death-Cum-Retirement Benefit) Scheme, 1981 (hereinafter referred to as DCRB Scheme. 1981) to the petitioners who served the West Bengal Recognized Non-Government Aided Educational Institutions and who retired or died in harness prior to 01.04.1981.
The DCRB Scheme, 1981 came into force with effect from 01.04.1981 in terms of this Department’s Notification No. 136-Edn (B) dated 15.05.1985 for the employees who were in service as on 01.04.1981 under the West Bengal Recognized Non- Government Aided Educational Institutions.
Subsequently, in terms of GO. No 163-Edn (B) dated 15.06.1990, the benefit of the DCRB Scheme, 1981 was extended to the teaching and non-teaching employees covered by the aforesaid scheme, who retired prior to 01.04.1981 on the same terms and conditions subject to due adjustment of pension and ex-gratia increases and aforesaid as were or are being drawn by such pensioners.
2. In terms of GO. No. 1610-Edn (S) dated 17.08.1968 with effect from 01.04.1966, the Pension Scheme for the employees of the Secondary Schools was introduced and in terms of G.O. No. 2299 Edn (P) dated 12.12.1972 with effect from 01.04.1968, the Pension Scheme for the
Primary Schools teachers was introduced. These two Pension Schemes are referred to as ‘Old Pension Scheme’.
3. It has also been observed by this Department that the following categories of the employees were not covered under DCRB Scheme, 1981.
a) those employees who retired/died prior to introduction of the ‘Old Pension Scheme’ (before 01.04.1966 in case of the employees of Secondary School under the West Bengal Recognized Non-Government Aided Educational Institution and before 01.04.1968 in case of the primary school teachers under the West Bengal Recognized Non-Government Aided Educational Institution.
b) those employees who retired prior to introduction of the 1981 pension Scheme but rendered more than one year approved qualifying service but less than 10 years approved qualifying service.
c) those primary school teachers (who were appointed before 01.04.1968) whose terminal benefits were settled by paying Contributory Provident Fund and Gratuity as per their option under rule 26 of the School Education Department’s Notification No. 3767-Edn dated 1.11.1035;
d) those employees who retired prior to introduction of the DCRB Scheme, 1981 and enjoyed pension as per ‘Old Pension Scheme’ till death before issuance to GO. No. 163- Edn(B) dated 15.06.1990;
e) those employees who died in harness prior to 01.04.1981 after rendering approved qualifying service for 20 years or more. In such cases family pension for 5 years was sanctioned as per provision of the ‘Old Pension Scheme’ but stopped at the expiry of 5 years (before 15.06.1990) from the date of the death of the incumbent.
f) those employees who died in harness prior to 01.04.1981 after rendering at least one year’s approved qualifying service but not more than 20 years’ approved qualifying service; and
g) those employees who died in harness or retired in between the period from 01.04.1981 to 30.06.1990 (both days are inclusive) before exercising any option under the DCRB Scheme, 1981.
4. Hence, the extension of pensionary benefit to the employees or their widows to the above categories was under the active consideration of the State Government for sometime past. After considering the fact, as a social security measure, the Governor has been pleased to extend pensionary benefit under DCRB Scheme, 1981 to such windows of those employees who retired or died in harness prior to 01.04.1981, if the concerned employees rendered at least one year’s approved qualifying service in the West Bengal Non- Government Aided Educational Institutions.
The employees of such categories may also be brought under the purview of the DCRB Scheme, 1981. The financial benefit may be given with effect from 15.06.1990 or from the date of application for pension/family pension whichever is later. The category as mentioned under para3(g) above also shall also come within the ambit of this order.
5. In case of primary school teachers, District Inspector of Schools Primary Education) shall be the pension Sanctioning Authority whereas the Director of School Education, West Bengal or any officer(s) authorised by Government, on his behalf shall be the Pension Sanctioning Authority in respect of the employees of Secondary Schools under the West Bengal Recognized NonGovernment Aided Educational Institution.
6. The benefit should be extended only to the living ex-employees (as mentioned under para-3 above) or their living widows, as the case may be.
7. Retirement benefits, if received by the employees in the old scheme should be adjusted/ refunded to the Government under the appropriate head of account.
8. The Director, Pension, Provident Fund and Group Insurance, West Bengal shall issue Pension payment Order in all cases.
9. In cases of pension or family pension in respect of primary school teacher, on receipt of duly filled Comprehensive Forms as per G.O. No. 88-SE (B) dated 26.05.1998 from the exemployee or the living widow of the ex-employee as the case may be the teacher Head Teacher/
Teacher-in-Charge of the concerned Primary School will verify and submit the same to the SubInspector of Schools concerned who will further verify the particulars of the incumbent within 30 days from the date of receipt and submit the same alongwith Service Book to the District Inspector of Schools (PE) for onward transmission of the same immediately to the Director, Pension, Provident Fund and Group onward transmission of the same immediately to the Director, Pension, Provident Fund and Group Insurance, West Bengal for issuance of Pension Payment Order immediately as per West Bengal Recognised Non- Government Educational Institution (Death-cum-Retirement Benefit) Scheme, 1981.
10. In case of the pension/family pension in respect of employees of Secondary Schools under the West Bengal Recognized Non-Government Aided Educational Institutions, on receipt of duly filled Comprehensive Forms as per G.O. No. 88-SE (B) dated 26.05.1998 from the ex-employees or the living widow of the ex-employee as the case may be, the Head of the Institution of the concerned School will verify and submit the same alongwith Service Book to the District Inspector of Schools (SE) concerned, who will further verify the particulars of the incumbent within 30 days from the date of receipt and submit the same immediately to the Director, Pension, Provident Fund and Group Insurance. West Bengal for issuance of Pension payment Order immediately as per West Bengal Recognized Non-Government Educational Institution Employees (Death-cum-Retirement Benefit) Scheme, 1981.
11. The Director, Pension, Provident Fund and Group Insurance, West Bengal will be informed accordingly.
12. The Principal Accountant General (A&E), West Bengal may issue Pension Payment Order in respect of those pension cases, received prior to issuance of this order.
13. This order issues with the concurrence of the Finance Department, Government of West Bengal pension Branch under their U.O. 642-F (Pen) dated 08.10.2010.

বিষয়: পশ্চিমবঙ্গ স্বীকৃত অ-সরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানের অধীনে 01.04.1981-এর আগে অবসর নেওয়া বা মারা যাওয়া কর্মচারীদের জন্য পেনশন/পারিবারিক পেনশন।
পশ্চিমবঙ্গের স্বীকৃত বেসরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানের (এখন থেকে কর্মচারী হিসাবে উল্লেখ করা হয়েছে) যারা অবসর নিয়েছেন বা মারা গেছেন তাদের কর্মচারীদের ক্ষেত্রে পেনশন/পারিবারিক পেনশনের এনটাইটেলমেন্টের বিষয়ে স্পষ্টীকরণ চেয়ে স্কুল শিক্ষা বিভাগ বিভিন্ন কোণ থেকে বেশ কয়েকটি প্রতিনিধিত্ব পেয়েছে। পশ্চিমবঙ্গ স্বীকৃত বেসরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানের অধীনে 01.04.1981 এর আগে ব্যবহার করা হয়েছে। এই বিভাগটি কলকাতার মাননীয় হাইকোর্ট কর্তৃক গৃহীত বেশ কয়েকটি আদেশও পেয়েছে যা উত্তরদাতা কর্তৃপক্ষকে পশ্চিমবঙ্গ স্বীকৃত বেসরকারি শিক্ষা প্রতিষ্ঠান কর্মচারী (মৃত্যু-কাম-অবসর সুবিধা) প্রকল্পের অধীনে পেনশন/পারিবারিক পেনশন বাড়ানোর নির্দেশ দিয়েছে, 1981 ( অতঃপর DCRB স্কিম 1981 হিসাবে উল্লেখ করা হয়েছে) যারা পশ্চিমবঙ্গের স্বীকৃত বেসরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানে কাজ করেছেন এবং যারা 01.04.1981 এর আগে অবসর গ্রহণ করেছেন বা মারা গেছেন।
DCRB স্কিম, 1981 কার্যকর হয়েছে 01.04.1981 থেকে এই বিভাগের বিজ্ঞপ্তি নং 136-Edn (B) তারিখের 15.05.1985 তারিখের কর্মচারীদের জন্য যারা পশ্চিমবঙ্গ স্বীকৃত Non এর অধীনে 01.04.1981 তারিখ পর্যন্ত চাকরিতে ছিলেন। – সরকারী সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠান।
পরবর্তীকালে, জিও পরিপ্রেক্ষিতে। নং 163-Edn (B) তারিখ 15.06.1990, DCRB স্কিম, 1981-এর সুবিধা পূর্বোক্ত স্কিম দ্বারা আওতাভুক্ত শিক্ষণ ও অশিক্ষক কর্মচারীদের জন্য প্রসারিত করা হয়েছিল, যারা 01.04.1981-এর আগে একই শর্তাবলীতে অবসর নিয়েছিলেন পেনশনের যথাযথ সমন্বয় এবং এক্স-গ্রেশিয়া বৃদ্ধি এবং পূর্বোক্ত হিসাবে এই ধরনের পেনশনভোগীদের দ্বারা আঁকা হয়েছে বা করা হচ্ছে।
2. GO এর পরিপ্রেক্ষিতে। নং 1610-Edn (S) 17.08.1968 তারিখে 01.04.1966 থেকে কার্যকর, মাধ্যমিক বিদ্যালয়ের কর্মচারীদের জন্য পেনশন স্কিম চালু করা হয়েছিল এবং GO নং 2299 Edn (P) তারিখের 12.12.1972 তারিখ থেকে কার্যকর হয় 01.04.1968, প্রাথমিক বিদ্যালয়ের শিক্ষকদের জন্য পেনশন স্কিম
চালু করা হয়েছিল। এই দুটি পেনশন স্কিমকে ‘ওল্ড পেনশন স্কিম’ বলা হয়।
3. এই বিভাগ দ্বারা এটিও লক্ষ্য করা গেছে যে কর্মচারীদের নিম্নলিখিত বিভাগগুলি ডিসিআরবি স্কিম, 1981-এর আওতায় আসেনি। ক) সেই সমস্ত কর্মচারীরা যারা ‘পুরাতন পেনশন স্কিম’ চালু করার আগে (01.04.1966 সালের আগে অবসরপ্রাপ্ত/মৃত্যু) পশ্চিমবঙ্গ স্বীকৃত বেসরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানের অধীনে মাধ্যমিক বিদ্যালয়ের কর্মচারীদের ক্ষেত্রে এবং 01.04.1968 এর আগে পশ্চিমবঙ্গ স্বীকৃত বেসরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানের অধীনে প্রাথমিক বিদ্যালয়ের শিক্ষকদের ক্ষেত্রে।
খ) সেই সমস্ত কর্মচারী যারা 1981 পেনশন স্কিম প্রবর্তনের আগে অবসর নিয়েছিলেন কিন্তু এক বছরের বেশি অনুমোদিত যোগ্যতা পরিষেবা প্রদান করেছেন কিন্তু 10 বছরের কম অনুমোদিত যোগ্যতা পরিষেবা প্রদান করেছেন৷
গ) সেই সমস্ত প্রাথমিক বিদ্যালয়ের শিক্ষক (যারা 01.04.1968 এর আগে নিযুক্ত ছিলেন) যাদের টার্মিনাল সুবিধাগুলি 1.11.1035 তারিখের স্কুল শিক্ষা বিভাগের বিজ্ঞপ্তি নং 3767-Edn-এর বিধি 26 এর অধীনে তাদের বিকল্প হিসাবে অবদানকারী ভবিষ্য তহবিল এবং গ্র্যাচুইটি প্রদানের মাধ্যমে নিষ্পত্তি করা হয়েছিল;
ঘ) সেই সমস্ত কর্মচারী যারা ডিসিআরবি স্কিম, 1981 প্রবর্তনের আগে অবসর নিয়েছিলেন এবং GO জারি করার আগে মৃত্যু পর্যন্ত ‘পুরাতন পেনশন স্কিম’ অনুসারে পেনশন উপভোগ করেছিলেন। নং 163- Edn(B) তারিখ 15.06.1990;
e) 20 বছর বা তার বেশি সময়ের জন্য অনুমোদিত যোগ্যতা পরিষেবা রেন্ডার করার পরে 01.04.1981-এর আগে যে সমস্ত কর্মচারী মারা গিয়েছিলেন। এই ধরনের ক্ষেত্রে ‘পুরাতন পেনশন স্কিম’-এর বিধান অনুসারে 5 বছরের জন্য পারিবারিক পেনশন মঞ্জুর করা হয়েছিল কিন্তু দায়িত্বশীলের মৃত্যুর তারিখ থেকে 5 বছরের (15.06.1990 এর আগে) মেয়াদ শেষ হলে তা বন্ধ হয়ে যায়।
চ) যে সমস্ত কর্মচারীরা 01.04.1981-এর আগে ন্যূনতম এক বছরের অনুমোদিত যোগ্যতা পরিষেবা প্রদানের পরে মারা গিয়েছিলেন কিন্তু 20 বছরের বেশি অনুমোদিত যোগ্যতা পরিষেবা প্রদান করেন না; এবং
ছ) যে সমস্ত কর্মচারীরা 01.04.1981 থেকে 30.06.1990 (দুটি দিনই অন্তর্ভুক্ত) সময়ের মধ্যে DCRB স্কিম, 1981-এর অধীনে যে কোনও বিকল্প ব্যবহার করার আগে ব্যবহারে মারা গিয়েছিলেন বা অবসর নিয়েছিলেন।
4. তাই, কর্মচারীদের বা তাদের বিধবাদের উপরোক্ত শ্রেণীতে পেনশন সুবিধার বর্ধিতকরণ অতীতের কিছু সময়ের জন্য রাজ্য সরকারের সক্রিয় বিবেচনাধীন ছিল। সত্যটি বিবেচনা করার পরে, একটি সামাজিক নিরাপত্তা ব্যবস্থা হিসাবে, গভর্নর DCRB স্কিম, 1981-এর অধীনে পেনশনারি সুবিধা প্রসারিত করার জন্য সন্তুষ্ট হয়েছেন যে সমস্ত কর্মচারীরা 01.04.1981-এর আগে অবসর নিয়েছেন বা মারা গেছেন, যদি সংশ্লিষ্ট কর্মচারীরা কমপক্ষে রেন্ডার করেন পশ্চিমবঙ্গের অ-সরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানে এক বছরের অনুমোদিত যোগ্যতা পরিষেবা।
এই ধরনের বিভাগের কর্মচারীদেরও ডিসিআরবি স্কিম, 1981-এর আওতায় আনা যেতে পারে। আর্থিক সুবিধাটি 15.06.1990 থেকে বা পেনশন/পারিবারিক পেনশনের জন্য আবেদনের তারিখ থেকে যেটি পরে হয় দেওয়া যেতে পারে। উপরের para3(g) এর অধীনে উল্লিখিত বিভাগগুলিও এই আদেশের পরিধির মধ্যে আসবে।
5. প্রাথমিক বিদ্যালয়ের শিক্ষকদের ক্ষেত্রে, স্কুল প্রাথমিক শিক্ষার জেলা পরিদর্শক হবেন পেনশন মঞ্জুরকারী কর্তৃপক্ষ যেখানে স্কুল শিক্ষার ডিরেক্টর, পশ্চিমবঙ্গ বা সরকার কর্তৃক অনুমোদিত কোনো কর্মকর্তা (গুলি), তার পক্ষে পেনশন মঞ্জুরকারী কর্তৃপক্ষ হবেন পশ্চিমবঙ্গ স্বীকৃত বেসরকারি সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানের অধীনে মাধ্যমিক বিদ্যালয়ের কর্মচারীদের বিষয়ে।
6. সুবিধাটি শুধুমাত্র জীবিত প্রাক্তন কর্মচারীদের (উপরে অনুচ্ছেদ-3 এর অধীনে উল্লিখিত) বা তাদের জীবিত বিধবাদের জন্য প্রসারিত করা উচিত, যেমনটি হতে পারে।
7. পুরানো স্কিমে কর্মচারীদের দ্বারা প্রাপ্ত হলে অবসরকালীন সুবিধাগুলি যথাযথ অ্যাকাউন্টের শিরোনামের অধীনে সরকারকে সমন্বয়/ ফেরত দিতে হবে।
8. ডিরেক্টর, পেনশন, প্রভিডেন্ট ফান্ড এবং গ্রুপ ইন্স্যুরেন্স, পশ্চিমবঙ্গ সকল ক্ষেত্রে পেনশন পেমেন্ট অর্ডার জারি করবে।
9. প্রাথমিক বিদ্যালয়ের শিক্ষকের ক্ষেত্রে পেনশন বা পারিবারিক পেনশনের ক্ষেত্রে, কর্মচারী বা প্রাক্তন কর্মচারীর জীবিত বিধবার কাছ থেকে 26.05.1998 তারিখের জিও নং 88-এসই (বি) অনুযায়ী যথাযথভাবে পূরণ করা ব্যাপক ফর্মের প্রাপ্তি যেহেতু ক্ষেত্রে হতে পারে সংশ্লিষ্ট প্রাথমিক বিদ্যালয়ের প্রধান শিক্ষক/
শিক্ষক-ইন-চার্জ তা যাচাই করবেন এবং সংশ্লিষ্ট বিদ্যালয়ের সাব-ইন্সপেক্টরের কাছে জমা দেবেন যিনি প্রাপ্তির তারিখ থেকে 30 দিনের মধ্যে দায়িত্বপ্রাপ্তদের বিবরণ আরও যাচাই করবেন এবং ডিরেক্টর, পেনশন, ভবিষ্য তহবিল এবং গোষ্ঠীর কাছে অবিলম্বে ডিরেক্টর, পেনশন, ভবিষ্য তহবিল এবং গ্রুপ ইন্স্যুরেন্স, পশ্চিমবঙ্গ স্বীকৃত অ-সরকারি শিক্ষা প্রতিষ্ঠান (মৃত্যু-কাম-অবসর সুবিধা) স্কিম, 1981 অনুযায়ী অবিলম্বে পেনশন পেমেন্ট আদেশ জারি করার জন্য পশ্চিমবঙ্গ।
10. পশ্চিমবঙ্গ স্বীকৃত বেসরকারী সাহায্যপ্রাপ্ত শিক্ষা প্রতিষ্ঠানের অধীন মাধ্যমিক বিদ্যালয়ের কর্মচারীদের ক্ষেত্রে পেনশন/পারিবারিক পেনশনের ক্ষেত্রে, 26.05 তারিখের GO নং 88-SE (B) অনুসারে যথাযথভাবে পূরণকৃত ব্যাপক ফর্মের প্রাপ্তি। 1998 প্রাক্তন কর্মচারী বা প্রাক্তন কর্মচারীর জীবিত বিধবার কাছ থেকে, যেমনটি ক্ষেত্রে হতে পারে, সংশ্লিষ্ট স্কুলের প্রতিষ্ঠানের প্রধান যাচাই করবেন এবং সার্ভিস বুক সহ সংশ্লিষ্ট জেলা পরিদর্শক (এসই) এর কাছে জমা দেবেন, যারা প্রাপ্তির তারিখ থেকে 30 দিনের মধ্যে দায়িত্বশীলের বিবরণ যাচাই করবে এবং অবিলম্বে ডিরেক্টর, পেনশন, ভবিষ্য তহবিল এবং গ্রুপ ইন্স্যুরেন্সের কাছে জমা দেবে। পশ্চিমবঙ্গ স্বীকৃত বেসরকারি শিক্ষা প্রতিষ্ঠান কর্মচারী (মৃত্যু-সহ-অবসর সুবিধা) স্কিম, 1981 অনুযায়ী অবিলম্বে পেনশন প্রদানের আদেশ জারি করার জন্য পশ্চিমবঙ্গ।
11. ডিরেক্টর, পেনশন, প্রভিডেন্ট ফান্ড এবং গ্রুপ ইন্স্যুরেন্স, পশ্চিমবঙ্গকে সেই অনুযায়ী অবহিত করা হবে৷
12. প্রিন্সিপাল অ্যাকাউন্ট্যান্ট জেনারেল (A&E), পশ্চিমবঙ্গ এই আদেশ জারি করার আগে পেনশনের ক্ষেত্রে পেনশন পেমেন্ট অর্ডার জারি করতে পারে।
13. এই আদেশটি 08.10.2010 তারিখে তাদের UO 642-F (পেন) এর অধীনে অর্থ বিভাগ, পশ্চিমবঙ্গ সরকারের পেনশন শাখার সম্মতিতে জারি করা হয়েছে।
