NOTIFICATION

No. 809-SE(Pry), Dated: 15.07.2002

In exercise of the power conferred by the sub-section (1) and clause (K) of sub-section (2) of section 106 of the West Bengal Primary Education Act, 1973 (West Bengal Act XLIII of 1973) (hereinafter referred to as the said Act), the Government is pleased to make the following rules. The rules will be in suppression of all previous rules and will come into effect immediately.

RULES

1. Short title and application:

(1) These rules may be called the West Bengal Primary Education (Transfer of Teachers including Head Teacher) Rules, 2002.

(2) These rules shall apply to Teachers including Head Teachers for the purpose of transfer from one primary school to another within the jurisdiction of a Council.

2. Definitions:

In these rules, unless the context otherwise requires.

(a) “The Act” means the West Bengal Primary Education Act, 1973 (West Bengal Act XLIII of 1973);

(b) “Board” means the West Bengal Board of Primary Education established under the Act;

(c) “Council” means a District Primary School Council established under the Act;

(d) “Head Teacher” means the teacher of a Primary School appointed as a Head Teacher of the Primary School by the Council;

(e) “Primary School” means a School or a department of a School set up under the Act;

(f) “Teacher” means a person who holds a teaching post in a primary school or in a junior basic school, appointed on a regular and whole time basis and is paid wholly from the funds under the control of the State Government in the School Education Department.

3. Roll Strength of a Teacher

A Primary Teacher under the jurisdiction of the Council ordinarily will have one teacher for every forty pupils or part thereof, not being less than twenty in a hilly, forested or other thinly populated area. A second teacher may be admissible when the roll strength exceeds sixty. A third teacher may be admissible when the Roll strength exceeds one hundred. Similarly, a fourth teacher may be admissible when the Roll strength exceeds one hundred forty and so on. But in no case a primary school is to have less than two teachers.

4. Condition for Transfer

A Council may –

(a) On its own motion, or

(b) On an application from a teacher, transfer approved teacher within its jurisdiction from one primary schools to another primary schools on the condition that such approved teacher is confirmed and has completed minimum two years of continuous service both in case of mutual or single transfer;

Provided that the Council may, if it considers necessary for proper utilization of service of a primary teacher in the interest of education, transfer and approved teacher without maintaining any time limit of service;

Provided further that where there is a surplus teacher according to Roll strength as stated in rule 3, the Council may, on its own motion, transfer such approved teacher without maintaining any time limit of service by way of rational adjustment of teacher in a primary school having deficit teacher in the following order of preference:

(i) A primary school without an approved teacher,
(ii) A primary school having a single teacher, and
(iii) Other primary school having shortage of teacher.

5. Procedure for Transfer

(1) A teacher seeking transfer under clause b of rule 4, shall submit his application for transfer with reasons thereof to the concerned Sub-Inspector of Schools during the month of December of each year and the concerned Sub-Inspector of Schools shall subsequently send such application with his specific views to the respective Council by January of the Succeeding year.

(2) Subject to sub rule (3) the Council shall consider such application and take a decision in respect of transfer by February and March of each year. Every transfer order shall be effected either at the end or at the beginning of the academic year.

Provided that if it is considered expedient to do so by the Council under a exceptional circumstances the application for transfer may be considered at any time with the approval of the Board.

(3) The Council may, while processing the application for transfer of approved teachers, consider the applications of such teachers as stated below on the priority basis according to the following order of preference, namely:

(a) A physically handicapped teacher having more than fifty percent of handicappedness of such teacher possessing a supporting document issued by the competent authority;
(b) A female teacher who has to face serious inconvenience in attending the school regularly due to her present place of posting;
(c) A teacher suffering from acute incurable disease like cancer, kidney element etc. and such teacher possessing a supporting document issued by the competent authority;

(4) After considering the application for transfer of an approved teacher, the Council may accept or reject the application for transfer and such decision of the Council shall be final.

(5) If the application of the approved teacher is accepted, the Council shall issue an order of transfer under the signature of the Secretary of the Council and such order shall be communicated to the teacher and other concerned forthwith.

(6) On receipt of the order of transfer, the Sub-Inspector of School s of the concerned Council shall immediately issue release order in favour of the teacher, so transferred, with a direction the new place of posting.

(7) The concerned teacher shall after receiving the release order, join the new place of posting as directed under sub-rule 6. A transferred teacher shall be entitled to the joining time as stated under rule 7 depending upon the distance between two schools by normal route.

(8) The transferred teacher shall at the time of joining new place of posting submit a joining report to the concerned Sub-Inspector of Schools who shall endorse a copy of the joining report to the Secretary to the Council.

6. Bar to Transfer

(1) No teacher shall be eligible to apply for transfer for a period of five years from the date of transfer.

(2) No teacher shall be eligible for transfer if he attains the age of fifty seven years.

(3) No prayer of transfer shall be entertained for next five years if the transfer order is not carried out by an approved teacher in whose favour a transfer order is issued.

7. Joining Time

A teacher while carrying out the order of transfer shall be entitled to joining time as specified below namely:

Distance between two Schools by normal route	Joining Time
Up to 8 Kms	Nil
Above 8 Kms to 30 Kms	1 (one) day
Above 30 Kms but under 150 Kms	2 (two) days
Above 150 Kms	3 (three) days

8. Inter Council Transfer

In case of inter council transfer the Council shall follow the principles and procedures of the board in accordance with the provision conferred by the clause (K) of section 19 of the Act.

9. Disciplinary Proceedings

Where a teacher fails to comply with an order of transfer made under these rules, disciplinary proceedings against such teacher may be initiated.

10. Appeal

(1) A teacher aggrieved by an order of transfer may, within 30 days of the date of receipt of such order, prefer an appeal to the Board.

(2) Such an aggrieved teacher shall, before preferring any appeal against as order of transfer under these rules, be required to comply with the order of transfer.

(3) The Board may dismiss the appeal or pass an order directing the Council to modify or reverse its decision, and the Council shall comply with such order.

11. Interpretation

If any question arises relating to the interpretation of these rules, the Council shall refer the matter to the Board and the decision of the Board shall be final.

পশ্চিমবঙ্গ প্রাথমিক শিক্ষা আইন, 1973 (1973 সালের পশ্চিমবঙ্গ আইন XLIII) এর উপ-ধারা (2) এর উপ-ধারা (1) এবং ধারা (কে) দ্বারা প্রদত্ত ক্ষমতা প্রয়োগে (এখন উল্লেখ করা হয়েছে) উল্লিখিত আইন হিসাবে), সরকার নিম্নলিখিত বিধি প্রণয়ন করতে পেরে সন্তুষ্ট। নিয়মগুলি পূর্ববর্তী সমস্ত বিধিগুলির দমনে থাকবে এবং অবিলম্বে কার্যকর হবে৷

নিয়ম

1. সংক্ষিপ্ত শিরোনাম এবং অ্যাপ্লিকেশন:

(1) এই নিয়মগুলিকে পশ্চিমবঙ্গ প্রাথমিক শিক্ষা (প্রধান শিক্ষক সহ শিক্ষকদের বদলি) বিধি, 2002 বলা যেতে পারে৷

(2) কাউন্সিলের এখতিয়ারের মধ্যে একটি প্রাথমিক বিদ্যালয় থেকে অন্য বিদ্যালয়ে স্থানান্তরের উদ্দেশ্যে প্রধান শিক্ষক সহ শিক্ষকদের ক্ষেত্রে এই নিয়মগুলি প্রযোজ্য হবে৷

2. সংজ্ঞা:

এই নিয়মে, যদি না প্রেক্ষাপট অন্যথায় প্রয়োজন হয়।

(ক) “অ্যাক্ট” মানে পশ্চিমবঙ্গ প্রাথমিক শিক্ষা আইন, 1973 (1973 সালের পশ্চিমবঙ্গ আইন XLIII);

(খ) “বোর্ড” অর্থ আইনের অধীনে প্রতিষ্ঠিত পশ্চিমবঙ্গ প্রাথমিক শিক্ষা বোর্ড;

(গ) “কাউন্সিল” অর্থ আইনের অধীনে প্রতিষ্ঠিত একটি জেলা প্রাথমিক বিদ্যালয় পরিষদ;

(ঘ) “প্রধান শিক্ষক” অর্থ পরিষদ কর্তৃক প্রাথমিক বিদ্যালয়ের প্রধান শিক্ষক হিসাবে নিযুক্ত একটি প্রাথমিক বিদ্যালয়ের শিক্ষক;

(ঙ) “প্রাথমিক বিদ্যালয়” অর্থ আইনের অধীনে স্থাপিত একটি বিদ্যালয় বা বিদ্যালয়ের একটি বিভাগ;

(f) “শিক্ষক” অর্থ এমন একজন ব্যক্তি যিনি একটি প্রাথমিক বিদ্যালয়ে বা একটি জুনিয়র বেসিক স্কুলে শিক্ষকতার পদে অধিষ্ঠিত, নিয়মিত এবং পুরো সময়ের ভিত্তিতে নিযুক্ত হন এবং বিদ্যালয়ে রাজ্য সরকারের নিয়ন্ত্রণাধীন তহবিল থেকে সম্পূর্ণ অর্থ প্রদান করা হয় শিক্ষা বিভাগ.

3. একজন শিক্ষকের রোল স্ট্রেংথ

কাউন্সিলের এখতিয়ারের অধীনে একজন প্রাথমিক শিক্ষকের সাধারণত প্রতি চল্লিশজন ছাত্র বা তার অংশের জন্য একজন শিক্ষক থাকবেন, পাহাড়ী, জঙ্গল বা অন্যান্য অল্প জনবসতিপূর্ণ এলাকায় বিশের কম হবে না। রোল শক্তি ষাট ছাড়িয়ে গেলে একজন দ্বিতীয় শিক্ষক গ্রহণযোগ্য হতে পারে। রোল শক্তি একশ ছাড়িয়ে গেলে তৃতীয় একজন শিক্ষক গ্রহণযোগ্য হতে পারে। একইভাবে, একজন চতুর্থ শিক্ষক গ্রহণযোগ্য হতে পারে যখন রোল শক্তি একশত চল্লিশ অতিক্রম করে ইত্যাদি। কিন্তু কোনো অবস্থাতেই একটি প্রাথমিক বিদ্যালয়ে দুইজনের কম শিক্ষক থাকার কথা নয়।

4. স্থানান্তরের শর্ত

একটি কাউন্সিল হতে পারে –

(ক) নিজস্ব গতিতে, বা

(খ) একজন শিক্ষকের আবেদনের ভিত্তিতে, অনুমোদিত শিক্ষককে তার এখতিয়ারের মধ্যে একটি প্রাথমিক বিদ্যালয় থেকে অন্য প্রাথমিক বিদ্যালয়ে স্থানান্তর করা হবে এই শর্তে যে এই অনুমোদিত শিক্ষক নিশ্চিত হয়েছেন এবং পারস্পরিক বা একক বদলির ক্ষেত্রে উভয় ক্ষেত্রেই ন্যূনতম দুই বছরের একটানা চাকরি সম্পন্ন করেছেন। ;

তবে শর্ত থাকে যে, পরিষদ, শিক্ষা, বদলি ও অনুমোদিত শিক্ষকের স্বার্থে প্রাথমিক শিক্ষকের সেবার যথাযথ ব্যবহারের জন্য প্রয়োজন মনে করলে চাকরির কোনো সময়সীমা বজায় না রেখে;

আরও শর্ত থাকে যে, যেখানে বিধি 3-এ বর্ণিত রোল শক্তি অনুযায়ী উদ্বৃত্ত শিক্ষক আছে, সেখানে কাউন্সিল তার নিজস্ব পদক্ষেপে, প্রাথমিক বিদ্যালয়ে শিক্ষকের যৌক্তিক সমন্বয়ের মাধ্যমে চাকরির কোনো সময়সীমা বজায় না রেখে এই ধরনের অনুমোদিত শিক্ষককে স্থানান্তর করতে পারে। পছন্দের নিম্নোক্ত ক্রমে শিক্ষকের ঘাটতি রয়েছে:

(i) অনুমোদিত শিক্ষকবিহীন একটি প্রাথমিক বিদ্যালয়,
(ii) একক শিক্ষক বিশিষ্ট একটি প্রাথমিক বিদ্যালয় এবং
(iii) অন্যান্য প্রাথমিক বিদ্যালয়ে শিক্ষকের অভাব রয়েছে।

5. স্থানান্তরের জন্য পদ্ধতি

(1) বিধি 4-এর খ-এর অধীন বদলি চাওয়া একজন শিক্ষক, প্রতি বছরের ডিসেম্বর মাসে সংশ্লিষ্ট স্কুলের সাব-ইন্সপেক্টরের কাছে তার কারণসহ বদলির আবেদন জমা দেবেন এবং পরবর্তীতে সংশ্লিষ্ট সাব-ইন্সপেক্টর অব স্কুলগুলিকে পাঠাবেন। পরবর্তী বছরের জানুয়ারির মধ্যে সংশ্লিষ্ট কাউন্সিলে তার সুনির্দিষ্ট মতামত সহ এই ধরনের আবেদন।

(2) উপ-বিধি (3) সাপেক্ষে কাউন্সিল এই ধরনের আবেদন বিবেচনা করবে এবং প্রতি বছরের ফেব্রুয়ারি এবং মার্চের মধ্যে স্থানান্তরের বিষয়ে সিদ্ধান্ত নেবে। প্রতিটি স্থানান্তর আদেশ শিক্ষাবর্ষের শেষে বা শুরুতে কার্যকর হবে৷

তবে শর্ত থাকে যে, যদি কোন ব্যতিক্রমী পরিস্থিতিতে পরিষদ কর্তৃক তা করা সমীচীন বলে বিবেচিত হয় তবে বোর্ডের অনুমোদন সাপেক্ষে যে কোন সময় স্থানান্তরের আবেদন বিবেচনা করা যেতে পারে।

(3) কাউন্সিল, অনুমোদিত শিক্ষকদের বদলির আবেদন প্রক্রিয়াকরণের সময়, নিম্নলিখিত পছন্দের ক্রম অনুসারে অগ্রাধিকার ভিত্তিতে নীচে বর্ণিত শিক্ষকদের আবেদনগুলি বিবেচনা করতে পারে, যথা:

(ক) একজন শারিরীক প্রতিবন্ধী শিক্ষক যার পঞ্চাশ শতাংশের বেশি প্রতিবন্ধী শিক্ষকের কাছে উপযুক্ত কর্তৃপক্ষের দ্বারা জারি করা সহায়ক দলিল রয়েছে;
(খ) একজন মহিলা শিক্ষক যাকে তার বর্তমান পদায়নের কারণে নিয়মিত বিদ্যালয়ে উপস্থিত হতে গুরুতর অসুবিধার সম্মুখীন হতে হয়;
(গ) ক্যান্সার, কিডনি উপাদান ইত্যাদির মতো তীব্র দুরারোগ্য রোগে ভুগছেন এমন একজন শিক্ষক এবং উপযুক্ত কর্তৃপক্ষ কর্তৃক জারি করা সহায়ক নথির অধিকারী এমন শিক্ষক;

(4) একজন অনুমোদিত শিক্ষকের বদলির আবেদন বিবেচনা করার পর, কাউন্সিল বদলির আবেদন গ্রহণ বা প্রত্যাখ্যান করতে পারে এবং কাউন্সিলের এই ধরনের সিদ্ধান্ত চূড়ান্ত হবে৷

(5) অনুমোদিত শিক্ষকের আবেদন গৃহীত হলে, কাউন্সিল কাউন্সিলের সচিবের স্বাক্ষরে বদলির আদেশ জারি করবে এবং এই আদেশ অবিলম্বে শিক্ষক এবং অন্যান্য সংশ্লিষ্টদের জানানো হবে।

(6) বদলির আদেশ প্রাপ্তির পর, সংশ্লিষ্ট কাউন্সিলের স্কুলের সাব-ইন্সপেক্টর অবিলম্বে শিক্ষকের অনুকূলে রিলিজ অর্ডার জারি করবেন, তাই বদলি করা হয়েছে, একটি নির্দেশনা সহ পোস্টিংয়ের নতুন জায়গায়।

(7) সংশ্লিষ্ট শিক্ষক রিলিজ অর্ডার প্রাপ্তির পর, উপ-বিধি 6 এর অধীনে নির্দেশিত পদের নতুন জায়গায় যোগদান করবেন। একজন বদলিকৃত শিক্ষক দুটি স্কুলের মধ্যে দূরত্বের উপর নির্ভর করে বিধি 7 এর অধীনে বর্ণিত যোগদানের সময় পাওয়ার অধিকারী হবেন। স্বাভাবিক রুট।

(8) বদলিকৃত শিক্ষক নিয়োগের নতুন জায়গায় যোগদানের সময় সংশ্লিষ্ট বিদ্যালয়ের সাব-ইন্সপেক্টরের কাছে একটি যোগদানের প্রতিবেদন জমা দেবেন যিনি কাউন্সিলের সচিবের কাছে যোগদানের প্রতিবেদনের একটি অনুলিপি অনুমোদন করবেন।

6. স্থানান্তর বার

(1) কোন শিক্ষক বদলির তারিখ থেকে পাঁচ বছরের জন্য বদলির জন্য আবেদন করার যোগ্য হবেন না।

(2) কোন শিক্ষক বদলির জন্য যোগ্য হবেন না যদি তার বয়স 57 বছর পূর্ণ হয়।

(৩) বদলির আদেশ কোন অনুমোদিত শিক্ষকের দ্বারা সম্পাদিত না হলে, যার পক্ষে বদলির আদেশ জারি করা হয়, পরবর্তী পাঁচ বছরের জন্য বদলির কোন প্রার্থনা গ্রহণ করা হবে না।

7. যোগদানের সময়

বদলির আদেশ পালন করার সময় একজন শিক্ষক নিচে উল্লেখিত হিসাবে যোগদানের সময় পাওয়ার অধিকারী হবেন:

স্বাভাবিক রুটে দুটি স্কুলের মধ্যে দূরত্ব	যোগদানের সময়
8 কিমি পর্যন্ত	শূন্য
8 কিমি থেকে 30 কিমি উপরে	1 (এক) দিন
30 কিমি এর উপরে কিন্তু 150 কিমি এর নিচে	2 (দুই) দিন
150 কিলোমিটারের উপরে	৩ (তিন) দিন

8. ইন্টার কাউন্সিল ট্রান্সফার

আন্তঃপরিষদ স্থানান্তরের ক্ষেত্রে কাউন্সিল আইনের ধারা 19 এর ধারা (কে) দ্বারা প্রদত্ত বিধান অনুসারে বোর্ডের নীতি ও পদ্ধতি অনুসরণ করবে।

9. শাস্তিমূলক কার্যধারা

যদি কোনো শিক্ষক এই বিধিমালার অধীনে প্রণীত বদলির আদেশ পালনে ব্যর্থ হন, তাহলে সেই শিক্ষকের বিরুদ্ধে শাস্তিমূলক ব্যবস্থা নেওয়া হতে পারে।

10. আপিল

(1) বদলির আদেশ দ্বারা সংক্ষুব্ধ একজন শিক্ষক, এই ধরনের আদেশ প্রাপ্তির তারিখের 30 দিনের মধ্যে, বোর্ডের কাছে আপিল করতে পারেন৷

(2) এই ধরনের একজন সংক্ষুব্ধ শিক্ষক, এই বিধিগুলির অধীনে বদলির আদেশের বিরুদ্ধে কোনো আপিল করার আগে, বদলির আদেশ মেনে চলতে হবে৷

(3) বোর্ড আপীল খারিজ করতে পারে বা কাউন্সিলকে তার সিদ্ধান্ত পরিবর্তন বা প্রত্যাহার করার নির্দেশ দিয়ে একটি আদেশ পাস করতে পারে এবং কাউন্সিল এই আদেশ মেনে চলবে।

11. ব্যাখ্যা

এই বিধিগুলির ব্যাখ্যা সংক্রান্ত কোন প্রশ্ন দেখা দিলে, কাউন্সিল বিষয়টি বোর্ডের কাছে পাঠাবে এবং বোর্ডের সিদ্ধান্তই চূড়ান্ত হবে।
